1. Who We Are

2. What Data We Collect

We collect: name, email address, telephone number, property postcode, business/trading name, bank account details (Partners only), Instagram/LinkedIn/website handles (optional), and referral and commission data.

3. Why We Collect It

We process this data to: manage the Partner Programme; pay commission; send programme communications; and comply with our legal obligations.

4. Legal Basis

Processing is based on contract performance (running the Partner Programme) and legitimate interests (business administration).

5. How We Store It

Partner data is stored securely in an encrypted database. Bank account details are encrypted and used exclusively for commission transfers. We do not sell your data to any third party.

6. Retention

We retain partner data for 6 years from the end of the partnership to comply with HMRC record-keeping requirements, after which it is securely deleted.

7. Your Rights

Under UK GDPR you have the right to access, correct, or delete your personal data; to object to processing; and to data portability. To exercise any right, contact shiloh@forbesblinds.co.uk.

Partner Programme — Terms & Conditions

Forbes Blinds National Partner Programme · Effective from January 2025

1. Parties

These Terms and Conditions ("Terms") form the agreement between Forbes Blinds (trading name of [Shiloh Forbes / company name], "Forbes Blinds", "we", "us") and the individual or business that applies to and is accepted onto the Forbes Blinds National Partner Programme ("Partner", "you").

2. The Partner Programme

Forbes Blinds operates a referral-based Partner Programme under which approved Partners introduce prospective customers to Forbes Blinds in exchange for commission on completed sales. Participation in the Programme is subject to ongoing approval by Forbes Blinds and these Terms.

Forbes Blinds reserves the right to accept or decline any application at its sole discretion, without obligation to provide reasons.

3. Partner Obligations

As a Partner you agree to:

  • ·Represent Forbes Blinds accurately and professionally at all times;
  • ·Provide truthful and complete information when submitting referrals;
  • ·Not make false, misleading, or disparaging statements about Forbes Blinds, its products, or its competitors;
  • ·Not use the Forbes Blinds brand, logo, or name in any paid advertising, social media advertising, or print without prior written consent;
  • ·Comply with all applicable laws, including consumer protection and data protection legislation.

4. Exclusivity & Non-Compete

By joining the Partner Programme, you agree that during your active membership you will not:

  • ·Actively promote, sell, or refer business to any direct competitor of Forbes Blinds (a business whose primary offering is made-to-measure window treatments including blinds, curtains, shutters, or awnings);
  • ·Use knowledge, contacts, or materials obtained through the Partner Programme to benefit a competitor.

This exclusivity applies only to active referral activity, not to your general profession. If you have an existing relationship with a competing supplier prior to joining, you must disclose this on your application.

5. Referrals

A referral is valid when:

  • ·It is submitted via the Partner Portal using your unique referral code;
  • ·The referred party is not already a known Forbes Blinds lead or customer;
  • ·The referred party proceeds to place and complete an order.

Forbes Blinds reserves the right to decline a referral where the client is already in our system, or where the referral is found to be inaccurate or fraudulent. Duplicate referrals for the same client will not be accepted.

6. Commission

Commission is payable on completed, paid-in-full orders only. The applicable rate is as agreed at time of Partner approval and recorded in your Partner profile:

  • ·Standard rate: 5% of the net order value (excluding VAT);
  • ·Measured/surveyed rate: 8% of the net order value where the Partner provides pre-qualified measurements.

Commission will be paid by bank transfer within 14 days of the customer's final payment being received and cleared. Forbes Blinds will notify you via the Partner Portal when commission has been processed. Forbes Blinds reserves the right to withhold commission where a referral is disputed or where chargebacks or cancellations occur after payment.

7. Banking Details & Payment

Partners are responsible for providing accurate bank account details via the Partner Portal. Forbes Blinds accepts no liability for misdirected payments resulting from incorrect details provided by the Partner. Bank details are stored securely and used solely for commission payments.

8. Starter Kits & Marketing Materials

Paid starter kit items are non-refundable once dispatched. Free materials remain the property of Forbes Blinds and must be returned or destroyed on termination of the partnership. Marketing materials provided by Forbes Blinds must not be altered, rebranded, or used out of context.

9. Training Camp

Attendance at an FB Training Camp is recommended for all Partners and mandatory for Installer Partners before accepting any installation jobs. Training camp fees (where applicable) are non-refundable except in circumstances agreed in writing with Forbes Blinds.

10. Intellectual Property

All Forbes Blinds branding, imagery, trade names, and materials are the intellectual property of Forbes Blinds. Partners are granted a limited, non-exclusive, non-transferable licence to use Forbes Blinds materials solely for the purpose of promoting their participation in the Partner Programme. This licence terminates immediately upon exit from the Programme.

11. Confidentiality

Partners must keep confidential all non-public information relating to Forbes Blinds' pricing, suppliers, clients, processes, and business strategy obtained during the partnership. This obligation survives termination of the partnership for a period of 2 years.

12. Data Protection

Both parties agree to comply with all applicable data protection legislation, including UK GDPR. Partners must not share, store, or use any client personal data obtained through their role for any purpose other than making the referral. 13. Termination

Either party may terminate the partnership with 30 days' written notice. Forbes Blinds may terminate the partnership immediately and without notice if:

  • ·The Partner breaches these Terms;
  • ·The Partner acts in a way that damages the reputation of Forbes Blinds;
  • ·The Partner submits fraudulent or materially inaccurate referrals;
  • ·The Partner becomes subject to bankruptcy, insolvency proceedings, or a criminal conviction.

Upon termination, outstanding commission for verified completed orders submitted before the termination date will be paid in the normal payment cycle. No commission is payable on referrals submitted after the termination date.

14. Liability

Forbes Blinds' liability to a Partner under or in connection with these Terms is limited to the total commission paid to that Partner in the 12 months preceding the event giving rise to the claim. Forbes Blinds is not liable for indirect, consequential, or loss-of-profit claims. Nothing in these Terms limits liability for fraud or death or personal injury caused by negligence.

15. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

16. Amendments

Forbes Blinds may update these Terms from time to time. Partners will be notified of material changes via the Partner Portal or by email. Continued participation in the Programme following notification constitutes acceptance of the revised Terms.
